Whether an interview is required for an H-1B holder’s employment-based green card process
I hold an H-1B work visa. I found a sponsor and am going through EB-3 employment-based immigration.
I’d like to know if I will definitely have to go through a USCIS interview later.
Someone with lawful status in the U.S., such as H-1B, who then applies under EB-2 or EB-3 employment-based preference, used to be able to obtain a green card through a domestic change of status without an interview. But after the Trump executive order, interviews became mandatory across the board — however, more recently, due to the COVID-19 impact, there’s been an increasing trend of receiving the green card directly without an interview.
