After I-140 is approved, what documents do I need to submit when changing preference to second?
Hello. I’m a student preparing for employment-based immigration who ended up proceeding under third preference due to the company’s financial situation, even though I was eligible for second preference.
I’d now like to speed things up by applying to change from third preference to second preference. My I-140 has already been approved — I’d like to know what documents I need to submit for this.
If the immigrant petition (I-140) has already been approved, you submit the preference-change application together with Form I-485 Supplement J. If it hasn’t been approved yet, you don’t need to submit this separately — you would simply prepare all documents together at the time of filing I-485.
