At what point during the employment-based green card process can I start working?
I’d like to know at what point during the employment-based green card process I can begin working. Once PERM labor certification is approved, can I start working then?
My company wants me to start right away. I’d like to know exactly at which stage I’m officially allowed to work.
Employment-based cases generally proceed in 3 stages:
Stage 1: Labor certification (LC) approval through PERM
Stage 2: I-140 petition filing
Stage 3: I-485 filing
At these stages, you can apply for work authorization and work officially once you receive your work permit card. Since individual circumstances vary, we strongly recommend consulting with an immigration attorney about your specific status before applying for work authorization.
