Can a police station background check lead directly to removal proceedings?
For someone out of status, if they’re arrested by police and a background check is run, I’d like to know if they could be detained on the spot at that point as well.

There are cases where someone is arrested on the spot after a police background check, and even if temporarily released by criminal court, they could be arrested again the very next day.
When released by criminal court, it’s important to let your attorney know your status right away, so you can prepare for anything unfortunate that might happen a day or two later.
