Can I obtain my green card right away when going through the VAWA process?
In the past, I was going through the green card process, but due to family issues, my spouse refused to sponsor me for the green card, and I had even withdrawn my previously filed I-130.
I later proceeded again through VAWA and was told I-360 was approved.
I’d like to know specifically when I’d be able to obtain my green card, given that I-130 was also previously filed.
I’d also like to know if I need to wait for the visa bulletin like others do.
As soon as I-360 is approved, you can proceed with your green card at any time. In the past, you needed your immigrant priority (visa bulletin) turn to open before you could file I-485. One notable point: if you had previously filed I-130, your priority date can be moved up based on that earlier I-130 filing.
