Can I proceed directly to an employment-based green card without maintaining status?
I’m currently working under a work permit. The company I work for has offered to sponsor my green card, but since my current status is about to expire, I’m planning to switch to E-2 status to keep my stay lawful. My question is whether, once the green card process begins, I can proceed directly without maintaining status by relying on the E-2 filing.
You should think of status and immigration as two separate issues. Maintaining lawful status all the way through green card approval is the safest approach. If your I-485 is ultimately denied at the final stage, and you have no valid status at that point, you could be required to leave the country immediately.
