Can I pursue a green card through VAWA due to domestic violence?
I learned there’s an opportunity for someone who’s been a victim of a crime or domestic violence to be granted a green card.
Over the years I’ve experienced ongoing verbal abuse and psychological abuse from my husband, and there was occasional physical violence as well — I’d like to know if I qualify. I do have things like a police report prepared.
I have supporting evidence for the verbal abuse — I’d like to know if verbal abuse also counts as domestic violence.
Generally, verbal abuse also falls within the category of domestic violence, and VAWA does recognize verbal abuse as a form of abuse. However, the relationship between domestic violence and a VAWA application needs to be examined in the overall context. Simple marital discord alone makes it difficult to apply — it really needs to rise to the level of severe domestic violence and threats, and having solid evidence and witnesses is extremely important.
