Can only an H-1B holder pursue employment-based immigration?
I went through OPT on F-1 student status and was planning to work at a company after receiving H-1B approval, but I wasn’t selected in the H-1B lottery this time.
I’d like to extend OPT and try H-1B again next year, and the company has said they can sponsor me for a green card, so I’m asking here.
Employment-based immigration — EB-3, EB-2, and even NIW — can proceed regardless of your current status, with or without a work visa. If the company is willing to sponsor you, go ahead and proceed right away.
