I received a 5-year E-2 visa, but upon entering the U.S., I got a 2-year stamp in my passport. Does this stamp mean that, before the 2-year period expires, I can leave the border anywhere and re-enter, receiving another stamp again within the 5-year visa’s overall range? In this case, during entry inspection, would I also be reviewed on things like my business progress since then, or can I just leave and return as a formality without any preparation?
Or do I need to go through a separate process like a formal visa extension application?
During the 5-year period your visa remains valid, you can simply travel abroad temporarily and re-enter to get a new stamp extending your stay for 2 more years, or you can extend your stay through a domestic change-of-status filing regardless of the 5-year period.
Generally, each time you re-enter with a still-valid E-2 visa, you’re typically granted another 2-year I-94 stay period. You may be asked a few questions about the E-2 business at that time, but it’s rare to undergo a separate detailed qualification review based on performance documentation. Instead of re-entering to get a new 2-year I-94, you could also file an I-129 petition with USCIS to extend your I-94 period, but that involves a document review, so it could actually be more demanding than simply extending through re-entry.
