Is a green card holder’s inheritance process treated the same as a citizen’s?
My citizen spouse passed away, and I obtained my green card through marriage-based family sponsorship. I hadn’t yet applied for citizenship when my citizen spouse passed away.
I’ve heard a green card holder’s inheritance process is different — is that true?
A green card holder’s inheritance process does go through a somewhat different procedure than a citizen’s. To prevent a foreign green card holder from easily moving U.S.-based assets abroad, the U.S. requires setting up a trust account, and the inheritance process is managed through that trust account.
