My past 245(i) case stalled when my sponsoring parent passed away
I previously pursued 245(i) relief through my parent, but my father, the principal applicant, passed away, and the process couldn’t continue.
I understand that I, as his child, was also a potential beneficiary — I’d like to know if I can still use that earlier filing to proceed.
If the reason the process stopped back then was the principal applicant’s death, the immigration petition filed at the time is treated as though it could have been approved, so you would still qualify.
