    It sounds like you may have heard about proceeding through the 204(i) relief provision. However, the condition for this relief requires that you be residing in the U.S. at the time of death, so if you’re proceeding from Korea, you cannot obtain relief this way. Unfortunately, proceeding from abroad is not possible. If you were in the U.S. at the time of death, this would be applicable.

    This relief provision can apply even if the I-130 petition hasn’t been approved yet, and it’s a provision that can benefit not just the primary beneficiary, but also accompanying family members. Please keep this in mind.
