1. Substantial investment requirement: You must show a sufficient amount to successfully operate the business.
2. If changing status to E-2 from within the U.S., roughly $100,000–$150,000 is typically sufficient. If filing from Korea, you should expect to need roughly $200,000–$300,000.
3. Marginality requirement: Simply generating enough for the family members to get by through the business is not sufficient — you must show more than that. Investing solely to make a living does not meet the purpose of an investor visa. An investor visa means investing beyond what is needed simply to get by, in order to run a genuine business.
4. You must document the source of the investment funds. Generally, it is cleanest if the investment funds are transferred directly from your own account to your (or your company’s) U.S. account.
