What happens to my status if I leave my company while maintaining status under H-1B?
I’m maintaining my status under H-1B while working at a company. Recently, my relationship with a supervisor has soured, and I’m considering changing companies.
If I suddenly receive a termination notice, I’d like to know what happens to my status.
Generally, once you leave a company, your H-1B is considered extinguished. So you’d technically be in a position where you need to leave the country immediately. However, in practice, if you quickly find a new company to switch to and file the necessary paperwork with USCIS, your status can be continued as-is.
