Whether a period of unlawful presence at the time of green card acquisition affects citizenship application
I’m considering applying for citizenship. My concern is that I had some unlawful presence at the time I obtained my green card, but I got lucky and it was overlooked, resulting in approval.
I’d like to know if this unlawful-presence record could cause a problem for my citizenship application, or if my green card could be revoked because of it.
If your green card was obtained through family sponsorship, there’s no problem. If it was through employment, please calculate the period and check whether it exceeds 180 days. However, since this issue was effectively already resolved at the time your green card was granted, we think you likely received it precisely because that issue had been cleared up. It should be fine.
