About obtaining a green card after filing an I-601 waiver
I was maintaining F-1 status, but due to a past issue with my school, I’m now facing removal as someone out of status. My school turned out to be involved in fraud, and my employment-based case was also denied because of it.
I’d like to know if relief is possible in this situation through marrying a U.S. citizen. I’ve heard it’s possible by proving extreme hardship — I’d like to know how to go about that.
There are cases where someone prepares objective evidence, argues their case, and obtains a green card through an I-601 waiver. To prove extreme hardship, recent cases have shown that analyzing the full set of circumstances and demonstrating the difficulty through a Cumulative Effect approach tends to be the more successful path — please keep this in mind.
