Another DUI while my license was suspended from a previous DUI, and green card concerns
I hit a building while driving and just left the scene. The problem is I was already unable to drive due to a prior DUI, so I was effectively driving without a license, and I’m planning to turn myself in. I’d like to know if my conduct rises to the level of a felony. I’m a green card holder and can’t predict what level of punishment to expect.
Driving without a license while intoxicated, if there was injury to a person, could rise to a felony depending on the circumstances of the incident. Driving in a suspended state alone could be a misdemeanor, but the key factors are the degree of intoxication, and whether fleeing the scene after the accident would be classified as a hit-and-run. If you’re not a citizen, please proceed with the awareness that removal proceedings are a real possibility.
