As an H-1B holder, my hours were changed to part-time due to COVID — is that okay?
I was a full-time H-1B holder, but due to COVID, I’ve been changed to part-time. I’d like to know if that’s okay. My wages have also dropped significantly since switching to part-time — I’d like to know how to maintain my status in this situation.
If an H-1B holder switches from full-time to part-time due to COVID, USCIS may later conclude, during your green card process, that you failed to maintain lawful status — which could ultimately become grounds for denial. So you should file and get approval for a petition amending your H-1B from full-time to part-time, which allows you to maintain your status lawfully through that process.
