Assault arrest and visa concerns
Hello.
I got caught up in an assault incident and was arrested. I’m currently resolving the case through a criminal defense attorney, but they said they don’t know much about immigration, so I’m asking here.
My attorney says the case can be dismissed — if that happens, does it get completely erased? And I’d like to know if my visa could be revoked as well.
If it’s dismissed, that’s the final outcome, so there’s no need to worry. Also, this won’t cause an issue for visa revocation or your green card process, so you don’t need to worry. However, if the assault was quite serious, or your conduct was particularly bad, there are cases where this gets reported to USCIS and results in visa revocation, and even cases referred to removal proceedings — but if your attorney is confident about a dismissal, we think it should be fine.
