Can I go back to Korea while out of status during the green card process after marrying a citizen?
I was maintaining F-1 status, but I let it lapse since I was told I’d still get my green card even while out of status.
Due to circumstances, I’d now like to go to Korea and receive my green card from there. I’d like to know if going back to Korea while out of status, in the middle of my marriage-based green card process, would still allow me to obtain the green card without issue.
If you become out of status during a marriage-based green card process and leave the U.S. without having obtained your green card yet, you would become subject to a re-entry bar.
