Citizenship of a child born during my PhD program
I’m in a PhD program and took a leave of absence from my job in Korea to come here together. While living in the U.S., I became pregnant. I’m due to give birth in June, and since there’s been a lot of news about birthright citizenship recently, I’m reaching out with this message.
We don’t plan to immigrate and intend to return to Korea once my husband graduates.
But citizenship could be a significant benefit for our newborn, so it’s disappointing to think it might suddenly be off the table.
I’d like to ask if there’s a way for us to give our child birthright citizenship.
If a parent is a green card holder/citizen, it’s automatically granted, but birthright citizenship is currently the subject of a constitutional lawsuit. So if it’s ruled unconstitutional, we think it would be automatically granted.
