Could there be an issue with an H-1B holder working from home?
As an H-1B holder, it’s become difficult to commute to the office, so I’ve been waiting at home and working remotely. I’d like to know if I need to file a separate notice since my work location has changed, or if there’s no issue at all. I’ve actually been working from home, unable to come into the office, for almost two months now.
By regulation, a separate amended petition is required when there’s a change in work hours or work location. However, since working from home was in accordance with a government order due to COVID, complying with that is obviously appropriate as well. Generally, it would be difficult for USCIS to individually verify every temporary departure from or change in a work location, and since this was in response to a stay-at-home order, as long as your tax filings are properly in order, we don’t think this would significantly affect your status.
