DUI, refusal of a breathalyzer test, and green card concerns
I got a DUI while my green card was in process. This is my second DUI — I had one 6 years ago — and this time I refused the breathalyzer test, and the case is still proceeding.
There was no accident. I refused the test out of concern for my green card, but I’m not sure what penalty or punishment to expect, so I’m asking here.
Since 6 years have passed and there was no injury to anyone, this likely won’t cause a major problem. However, since this falls within criminal law’s domain, refusing the breathalyzer test could result in a larger fine or penalty than you might expect.
