I filed for a green card while out of status, and I’m not sure if it’s safe to travel abroad using Advance Parole.
I’ve heard some say it’s fine to leave once it’s issued, while others say to be cautious.
We recommend not leaving the country. If a green card applicant has more than 180 days of unlawful presence, it’s best to forgo using Advance Parole. This is because someone with 180 days to under 1 year of unlawful presence is barred from re-entering the U.S. for 3 years once they leave, and someone with 1 year or more of unlawful presence is barred for 10 years.
