I received a suspended criminal sentence while my entry into the U.S. was delayed after receiving my immigrant visa.
A long time ago in Korea, I applied for immigration as an unskilled worker, had my interview, and received my immigrant visa.
However, for various reasons, I delayed entering the U.S. and obtaining my green card, and in the meantime received a 6-month prison sentence with 2 years of probation for a DUI.
I’d like to know if I can still obtain an immigrant visa again in this situation. My children also received immigrant visas at the time, but they’ve now turned 21 — I’d like to know if that’s still possible for them too.
It’s still possible to proceed again, but additional scrutiny of your DUI record may occur when the immigrant visa is issued. They’ll likely ask whether your probation has ended and how you’ve conducted yourself since then. As for your children, unfortunately, since they’re already over 21, they can no longer apply for an immigrant visa as accompanying family members.
