Unlawful presence before age 18 does not bar re-entry
I sent my child to study in the U.S. during middle school, but they fell out of status before turning 18 and returned to Korea as an adult. They’d now like to go back to the U.S. for college, and I’m worried the unlawful presence record could result in a re-entry denial.
Unlawful presence before age 18 does not trigger a re-entry bar. It also isn’t a disqualifying factor for visa issuance. So they should be able to obtain a student visa again and enter — please keep this in mind and prepare for their studies abroad with hope.
