I’d like to know what conditions and documents are needed to obtain an intracompany transferee visa.

Generally, the documents needed for an L visa application are:

Form I-129 and L Supplement — the U.S. employer must complete Form I-129, Petition for a Nonimmigrant Worker, along with the L Supplement, and submit it to USCIS.

U.S. employer’s support letter — a detailed support letter explaining the nature of the company, the reason for the transfer, the applicant’s employment history, job duties, and the applicant’s eligibility for an L visa.

Evidence of a qualifying relationship between the companies — documentation (such as articles of incorporation, annual reports, or financial statements) showing that the U.S. company and the foreign company are qualifying organizations.

Proof of the beneficiary’s employment — documentation proving the beneficiary was continuously employed by the foreign company for at least 1 year within the past 3 years, such as pay stubs, tax records, or a letter from the foreign employer.

Job description and organizational chart — a detailed job description for the U.S. position, and an organizational chart showing the beneficiary’s position within the U.S. company.

Beneficiary’s qualifications — documentation such as degrees, certificates, and resume.

Passport — valid for at least 6 months beyond the planned period of stay in the U.S.

DS-160 form — the online nonimmigrant visa application.

Passport photo meeting U.S. visa photo requirements.

Visa appointment confirmation page.

Visa application fee receipt.

Form I-797 — Notice of Action showing the I-129 petition was approved.

Optional documents include: evidence of sufficient company funds (financial statements, bank statements, or a business plan); office lease or ownership documents if the U.S. company is new; and dependent documents (passports, photos, DS-160) if the beneficiary is accompanied by a spouse and/or children under 21.
