If I don’t attend the re-interview, and remarry a different citizen spouse a year later, what happens?
After filing for a green card as a citizen’s spouse, I had one interview, but our relationship soured and I was notified of a re-interview. If I don’t attend the re-interview, and remarry a different citizen spouse a year later, what happens? My oldest child is already 19 — is this only possible if they married before turning 18? Does it matter that I’ve already had one prior filing attempt?
1) If the spouse doesn’t attend the interview before a conditional green card is issued, USCIS may question the genuineness of the marriage.
2) Even if you don’t pass the interview and don’t receive the conditional green card, as long as it’s not due to being out of status, you can still marry a different citizen spouse and apply for a green card.
3) Only a child who married before turning 18 receives family-sponsorship benefits, and you can reapply even if you have a prior application history.
