If unlawful presence exceeds 180 days, can I re-enter after 3 years?

    Even if unlawful presence doesn’t exceed 180 days, entry into the U.S. still depends on whether you can obtain a visa through the embassy. A visa can be denied for a variety of reasons.
    A consular officer will make the decision at your interview, but if you keep trying, you will likely eventually receive one, absent any special disqualifying reason.
