My I-485 was denied while I was out of status — can I still re-enter?

    If you leave the U.S. after your I-485 has been denied, and your period of unlawful presence was between 180 days and under 1 year, leaving triggers a 3-year re-entry bar. If it was 1 year or more (365 days or more), you will not be permitted to re-enter for 10 years unless you receive a waiver. So if you leave now, it appears you would likely be barred from re-entry for 10 years or more.
