If you’re concerned about the possibility of being denied re-entry as a green card holder, first check the items below. If the underlying conduct reflects moral turpitude, the reviewing officer has discretion to deny re-entry.
1. Whether any related criminal or probationary proceedings have fully concluded
2. Whether there are any outstanding warrants for you in the U.S.
3. Whether you have clear ways to prove ties to the U.S., such as an address or property
Considering the above, you can apply for a re-entry permit. After applying, you can get fingerprinted within 2–3 months and then leave the country. Be sure to carry documentation of the outcome of any criminal matters.
Keep in mind, however, that having a re-entry permit does not guarantee 100% that you will be admitted. The inspecting officer retains discretion and may reach a different conclusion than USCIS did.
