Work permit extension while waiting for an I-140 decision
I previously held H-1B status. I was in the middle of an employment-based green card process, and my work status ended partway through. My I-140 decision still hasn’t come out.
I’ve heard that even though my work visa has expired, I’m not out of status because I still have a receipt notice.
Do I need to reapply for work authorization?
If 365 days pass while your I-140 decision is still pending, your previous work visa is automatically extended in one-year increments.
