Issue not receiving a W-2 tax form after changing jobs while on H-1B status
Last year, before transferring my H-1B, I worked at my previous employer for about a year. There was a dispute when I left on bad terms, and they’re not sending me my W-2.
I currently have no way of confirming whether they simply never issued a W-2, or whether they reported it to the government but just aren’t sending my copy.
I’m worried this could cause a tax filing issue and future immigration-law problems for my green card process.
H-1B generally ties you to working only for that specific employer, but even after changing employers, as long as USCIS approved the transfer, your status should be considered maintained. If you formally worked at the previous company, request the W-2 in writing, and if they still refuse, consult with an accountant and mention that you’ll contact the IRS to take action. At this point, it would help to get support from an accountant or attorney.
