My status after previously signing to voluntarily depart but not actually leaving
Hello. In the past, I entered the U.S., was out of status, and while pursuing immigration, went through immigration court proceedings.
However, at the time, I signed agreeing to voluntary departure, but never actually left and have been living here since. Would I be able to pursue a green card in this case?
I’d like to know what my current status is.
In this case, you signed agreeing to voluntary departure, but if you never actually left, this can be viewed as effectively consenting to removal. So it’s fair to consider that you have a deportation order. Even with a deportation order, you can still obtain a green card through a family sponsorship process such as marriage. However, procedurally, there’s still the step of reopening the removal proceedings and going through that process.
