Question about a child who will become a citizen sponsoring an out-of-status parent, and returning to Korea
I’m living in the U.S. out of status, and my son is a green card holder.
My son will become a citizen in 2 years and plans to sponsor me, currently out of status. Due to my own circumstances, I’m planning to go back to Korea.
However, I’m worried about whether I can safely receive my parent-sponsored green card from Korea given my unlawful presence history. I’d like to know what the best approach would be.
If your period of unlawful presence in the U.S. exceeded 1 year, you would be barred from re-entry for 10 years. In practice, if you return to your home country now, there would be no realistic way to come back, so we recommend proceeding with the process from here instead.
