Question about a prior green card denial and a subsequent student visa application
I filed for an employment-based green card along with my whole family, but it was denied.
I’m now worried about what my chances are if I reapply on a student visa. I need to enroll my children in school, and I’m worried we might have to return to Korea.
The reason your employment-based case was denied could matter somewhat. If it was denied at the PERM stage, or ended due to the company’s financial issues, that likely shouldn’t be a major problem.
