Question about switching to E-2 spouse status while H-1B is pending
I’m planning to file for H-1B this coming April. But in case H-1B isn’t selected, I’d also like to file for an E-2 spouse visa as a backup — I’d like to know if that’s possible.

As long as your status remains continuously valid, a change is possible. Given the possibility that H-1B won’t be selected, I think it would be a safer strategy to file the E-2 spouse case using premium processing in the meantime, so you secure that outcome first while maintaining status safely.
