I’m going through an EB-3 (third-preference) employment-based case. If the hospital doesn’t have an open position, I’m not sure whether I should keep waiting or look for a new job. I’d also appreciate information about the priority date.

Ask the hospital the following: 1. Whether they plan to re-hire you, and 2. Whether you’d prefer to look elsewhere. If re-hiring isn’t possible because there’s no open position, you should look for a new hospital and go through the process of having a new I-140 approved. Your existing priority date remains valid as-is. Also note that if you use premium processing (expedited service), I-140 decisions can come back in as little as two weeks.
