Question about maintaining status and the tax issue (2)
I’m on work status. However, my company isn’t issuing me a W-2 tax form.
I understand that nonimmigrant visa (status) holders are generally expected to have their taxes reported via W-2, but the company is telling me to just use a 1099 instead.
What should I do?
If they give you a 1099, formally request a W-2 instead. If you’re feeling pressure due to your status, one option is to accept the 1099 for now and later attempt to switch it to a W-2-based form. What matters most is that you actually worked. There’s no strict rule requiring exclusively W-2 reporting, though W-2 reporting is the general practice. If a problem does come up, prepare documentation showing that you did everything you reasonably could.
