Question about the conditions for filing a spouse’s green card after obtaining my own first
I’m being sponsored and am currently in the I-140/I-485 process. Due to circumstances, my spouse has been traveling in and out of the U.S., so I filed I-485 on my own for this round, and I understand that my spouse’s green card application can only happen after my own I-485 is approved and I receive my green card. I’d like to know whether I need to remain with my current sponsoring company between the time I get my own green card and the time my spouse gets theirs.
There’s no requirement to remain with the sponsoring company while processing your spouse’s green card. Before you even obtain your own green card, your spouse can also apply as a derivative family member through Follow to Join — please keep this in mind. Also, for future reference, if you’ve already left the sponsoring company by the time you file the Follow-to-Join immigrant visa application, it would help to have your W-2s from that period and your separation letter ready.
