Whether concurrent filing is possible
I currently live in Korea and am preparing a green card application through NIW. My child is attending high school in the U.S. on an F-1 visa. In this situation, since I (the principal applicant) live in Korea while my child lives in the U.S., I’d like to know whether my child alone can file Form I-485 concurrently along with my green card application, even though I am not concurrently filing myself.
Concurrent filing isn’t possible in that way.
1. Either the child enters the U.S. first after receiving an immigrant visa together with the parent in Korea, or
2. The parent comes to the U.S. and files concurrently together, then leaves after obtaining Advance Parole, or
3. If the parent holds an H or L visa, the parent can come to the U.S., file concurrently together, and then leave the country.
