Re-entry bar due to unlawful presence and nonimmigrant visa (NIV) waiver review
I’m preparing to re-enter the U.S. after a past unlawful presence record.
I’d like to know how to prepare for the waiver. What matters most in a nonimmigrant visa (NIV) waiver review?
For reference, I was simply out of status.
The inadmissibility waiver is reviewed at the discretion of the consular officer at the U.S. Embassy in Korea. So as preparation beforehand, you should show the reason you were barred from entry, that you’re currently living a law-abiding life in Korea, why the waiver is needed, and confirm that you have no intent to permanently reside in the U.S. in the future. You should prepare this in writing in advance and prepare for the interview along the same lines. Ultimately, the waiver must be approved before you can receive a U.S. entry visa.
