What counts as a “spouse” for CR-1 Spouse Green Card purposes?
I’d like to know what qualifies as a “spouse” when applying for a green card, and whether same-sex couples are included. What is the definition of “spouse” for CR-1 Spouse Green Card purposes?
Do same-sex couples qualify?
Of course. A spouse means a legally married husband or wife. This includes same-sex couples. Simply cohabiting is not recognized as a valid marriage under immigration law. If the law of the country where a common-law marriage took place recognizes common-law marriage and grants the same rights and obligations as a traditional marriage, a common-law spouse can also be recognized as a valid spouse under immigration law.
We have actually filed such a case, and the conditional green card was issued without any issues.
