What documents does a U.S.-citizen spouse need to submit to USCIS?
I’d like to file for adjustment of status as the spouse of a U.S. citizen from within the U.S. I’d like to prepare the documents in advance before submitting to USCIS.
What documents do I need to prepare, and what forms should I use?
The documents to submit to USCIS are as follows:
1. Form I-130, petition to sponsor a U.S. citizen/green card holder’s spouse
2. Copy of the birth certificate showing the U.S. citizen/green card holder’s name
3. Copy of the citizen/green card holder’s passport
4. If a U.S. citizen but not born in the U.S., submit one of the following: naturalization certificate, citizenship certificate, or U.S. passport copy; for a green card holder, the green card
5. Form G-325A (one each for applicant and spouse)
6. Marriage certificate
7. Divorce decree, death certificate, or annulment document (to prove the citizen spouse’s prior marriage, if any, was legally terminated)
8. 6 passport-style photos (5×5) each of the U.S. citizen/green card holder and yourself
9. Form I-485, application for adjustment of status
10. Form I-864 affidavit of support, plus tax filing records and employment verification (if the spouse’s income is low, someone with substantial tax filings can serve as an additional co-sponsor)
11. Your Korean passport and visa copy, I-94, and family register documents (basic certificate, family relation certificate, marriage relation certificate, family census register)
12. Your medical exam results
When submitting the petition, documents proving the marital relationship generally include the marriage certificate, wedding photos, photos taken together with each other’s families, a joint lease agreement, a joint bank account, and affidavits from friends and family attesting to your marriage.
