What is my status if I quit F-1 school and pursue a marriage-based green card?
I’m in the U.S., registered my marriage to a citizen, and am currently preparing I-485 paperwork to apply for a green card.
According to my I-94, my entry status was J1, which I extended once, then changed to F1, and after the semester started, I dropped out of school upon marrying. Since there’s a condition that I must leave the U.S. within 15 days of dropping out,
my final lawful status date was September 30th.
I’d like to know if my current immigration status would be considered F1 (out of status) or No status, and whether I qualify for adjustment based on Immigration and Nationality Act (INA) section 245(i).
Based on what you’ve described, it’s fair to say you failed to maintain status as of your last status date (the date you dropped out of school).
