Whether an M-1 visa holder can change status to F-1

Generally, when receiving an M-1 visa, a change to F-1 is approved only in cases where H-1B should have originally been obtained, and in most other cases it’s not approved. However, changing status to an H-4 spouse visa is possible. Please refer to the details below.

To change status from M-1 (vocational school student) to H-4 (dependent of an H-1B holder), you need to submit Form I-539 (Application to Extend/Change Nonimmigrant Status), and you must demonstrate that you meet the H-4 status eligibility requirements. This includes proof of marriage to the H-1B holder and evidence of the spouse’s valid H-1B status.

Valid M-1 visa: You must have lawfully entered the U.S. in M-1 nonimmigrant status.
