Whether I can visit Korea after filing for a waiver while on J-1 and going through my green card process
Hello. I’m going through EB-2 green card immigration on J-1 status. Since my status has a home-residency requirement, I filed for a waiver, but circumstances now require me to visit Korea.
I’d like to know if there would be any problem entering Korea and then coming back in this case.
There are occasional cases where people run into trouble after returning to Korea while a waiver application (to extend DS-2019) is pending. In other words, since you’re going through your green card process, especially if I-140 has already been filed, your J-1 visa could be denied. We recommend not leaving the country.
