Whether I could be arrested by ICE while going through a marriage-based green card process
Hello. I’m out of status. I’m going through the green card process through my citizen spouse’s sponsorship, and now only the interview remains.
In the past, I submitted incorrect documents and received a deportation order from USCIS.
I’m worried about what unlucky outcome might be waiting for me at the interview. My immigration attorney hasn’t given me an answer on this. Can you tell me what to expect?
Even someone out of status isn’t necessarily waited on and arrested by ICE, but if a removal order is on file, ICE waiting to make an arrest is the standard procedure. You should expect this. That said, even going through an uncomfortable process (such as immigration detention), obtaining a green card is still possible. Please prepare bail money in advance as well. Bail is likely to run around $10,000.
