Status after choosing voluntary departure during past removal proceedings but not leaving
In the past, I was caught entering through the Canadian border and was referred to removal proceedings. Afterward, the court allowed voluntary departure, and I was let into the U.S. anyway — I’d like to know what my current immigration status is.
I’ve continued getting a driver’s license and living in the U.S. — I’d like to know if I could obtain a green card through parent sponsorship via my child.
If you promised voluntary departure in removal proceedings but didn’t actually leave, this has the same meaning as ‘removal.’ However, depending on the case, there are instances where even someone with a completed removal has still lived in the U.S. and pursued a green card through family sponsorship, so you can look into a path forward — it’s not necessarily impossible.
