Whether re-entry to the U.S. is possible despite a past unlawful presence record
I previously lived in the U.S. and was out of status at one point. I now need to visit the U.S. for business, but I think entry might be difficult because of my past unlawful presence.
I’d like to know if there’s a way.
There are separately established re-entry bar periods based on past unlawful presence. For example, unlawful presence exceeding 180 days results in a 3-year re-entry bar, and 1 year or more results in a 10-year re-entry bar. However, there are real cases of successfully re-entering by filing a waiver requesting that this bar be excused — you could try this process for a B1/B2 travel visa or a business visa.
